Justin Bieber vs Joustin Beaver – Game Maker Files Lawsuit After Bieber’s Camp Ask game to be Removed.
RC3 is fighting back. The company that created the Joustin Beaver App is striking back at Bieber’s camp over claims that they are infringing on the “Justin Bieber” trademark.
After looking at that picture…..I think there is a little infringement going on.
So did Bieber’s legal team. They sent RC3 a “Cease and Desist” letter, asking them to remove the product immediately. This in turn caused the company to file their lawsuit. They say that the app is protected under the First Amendment.
In my opinion the whole thing is indeed a play on the Beib, but that doesn’t make it illegal.
HOW YOU PLAY THE GAME.
You play the game as Joustin Beaver, floating on a log down the river. You are literally a Beaver that is prepared to Joust, complete with a jousting lance. You have to battle against “Phot-Hogs” because they are trying to take your picture. You have to knock them in the water with a lance. While you are battling hogs you might have to sign a few “Otter-graphs”.
RC3 is hoping that a judge rules that the game doesn’t constitute misappropriation of Bieber’s name for commercial purposes.
RC3 has to prove that they are not selling games because consumers think that it’s related to Justin Beaver. The consumer should not be confused. After seeing a picture of the cartoon Beaver, rockin’ the old Justin Beaver hair cut and school boy hoodie, I don’t think RC3’s case will hold up. In fact, they might have to pull the games completely off the shelf.
Honestly, I think they know that they are infringing, but someone was smart enough to file this lawsuit, giving them more time to sell the game, not to mention a nice boost in popularity by all of the stories covering the lawsuit.
