Bobby Shmurda Takes Plea Deal, Gets 7 Years; Find Out Why that’s Light and How Jail Phones & Cell Phones Got Him Locked Up in The First Place.
Don’t let Bobby Shmurda’s boyish smile and and baby face fool ya. Shmurda was no joke in these streets. Unfortunately he was also super-sloppy in these streets too. That’s how he eventually got caught. He was no Avon Barksdale; he not only didn’t move in silence, he rapped about.
When I heard he got locked up, I really didn’t pay attention to his actual charges. There were so many other things popping in the news at that time, the charges themselves became a footnote. Now that he has accepted a plea deal, and the case is in the news again, I took a closer look at the charges and my conclusion is 7 YEARS IS LIGHT!
THE TERMS OF HIS PLEA DEAL
Bobby (real name Ackquille Pollard) initially plead not guilty to all of his charges. He was scheduled to have a jury trial starting today, Monday September 12th, before accepting the plea deal. The plea deal itself was somewhat complex. Not only did Bobby have to plead guilty but his three co-defendants, Chad “Rowdy Rebel” Marshall, Nicholas McCoy and Santino Boderick had to agree to the same deal. It was originally all 4 or nothing.
The guilty pleas proposed were for 4th-degree conspiracy (to criminally posses a weapon in the second degree), which carries a sentence of 1-3 years, and 2nd-degree criminal weapons possession, which carries a sentence of 7 years.
Boderick, however, was facing an additional charge of attempted assault, meaning his offer was for a minimum of 15 years. Broderick eventually decided not to go along with the deal, and will be facing a jury trial as originally planned. The deal was then renegotiated to include just Shmurda, McCoy and Marshall. As part of the deal, they will get credited for time served and they will not be able to appeal.
WHY DO I SAY 7 YEARS WAS LIGHT?
Easy question. If you look closely at the indictment, Shmurda was living that life he was rapping about. He was a member of the GS9 gang. Those are Crips. The GS9’s turf runs from East 95th Street from Kings Highway to East New York Avenue in East Flatbush, Brooklyn. The arrests basically came from the sloppy way that the gang operated. Evidence was reportedly obtained via “surveillance video, inmates’ recorded phone conversations, DNA and ballistics test results, seized narcotics and drug paraphernalia, and eyewitness accounts. Honestly, all things that could have been avoided.
Bobby himself faced 5 charges on 8 counts. Cutting through all the legal talk, his 8 offenses break down to the following:
1 – He was present when shots were fired in the vicinity of the Brooklyn Supreme Court Building in January 2013.
2 – In a telephone conversation, he told another gang member that he shot a member of a rival gang in May 2013.
3 – He was involved in the sale of narcotics, including the sale of crack-cocaine. (Read More)
